1. Acceptance of Terms

By downloading, installing, accessing, or using the fomo desktop application or visiting https://www.fomodesktop.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the fomo application or services.

2. Description of Software & License

fomo provides a social-first non-custodial interface for monitoring, tracking, and interacting with decentralized blockchain protocols on macOS and Windows.

We grant you a personal, revocable, non-exclusive, non-transferable, limited license to download and execute the fomo desktop client strictly for your personal, non-commercial use in accordance with these Terms.

IMPORTANT RISK WARNING: Trading digital assets, cryptocurrencies, memecoins, and decentralized financial instruments involves extreme risk of financial loss. Prices are highly volatile and market conditions can change rapidly. You are solely responsible for your investment decisions.

3. Self-Custody & User Responsibility

Non-Custodial Architecture: fomo does not hold, custody, or manage your digital assets, private keys, or seed phrases. You maintain 100% ownership and control over your crypto wallets.
Credential Security: You are strictly responsible for safeguarding your private keys, seed phrases, and device access credentials. fomo cannot assist in recovering lost private keys or funds.
No Financial Advice: Content, leaderboards, feeds, or analytical tools in fomo do not constitute financial, investment, legal, or tax advice.

4. Prohibited Activities

When using fomo, you explicitly agree not to:

Violate any applicable local, state, federal, or international laws, regulations, or sanctions programs.
Engage in market manipulation, wash trading, front-running, or fraudulent activity.
Decompile, reverse-engineer, disassemble, or attempt to extract source code from binary builds of the app, except as permitted by applicable law.
Interfere with, overload, or disrupt the network infrastructure, RPC nodes, or backend servers supporting the application.

THE FOMO APPLICATION AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR MALICIOUS COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FOMO LABS, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR DIGITAL ASSETS, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE APPLICATION.

8. Indemnification

You agree to defend, indemnify, and hold harmless fomo Labs, its affiliates, officers, and employees from and against any claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or misuse of the software.

9. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law principles.

We reserve the right to modify these Terms at any time. Changes will be posted to this page with an updated effective date. Continued use of the software constitutes your acceptance of the revised Terms.
